Asbestos claims in the UK - The Tsunami Arrives The High Court judgment in the EL policy triggers test litigation which was handed down in November is seen by many as validating the longstanding market practice that policy cover for mesothelioma claims is triggered by the date of inhalation of asbestos and not by the date of injury many years later. The test litigation is now due to proceed to the Court of Appeal. In this session - led by Beachcroft LLP, Partner, Julian Miller – delegates will have a rare opportunity to hear from the Counsel in the EL policy triggers test litigation, Colin Wynter, QC, and Andrew Burns, Barrister, of Devereux Chambers, and reinsurance consultant Nigel Morson (formerly of the RSA) about developments to date and what next.
