Jeffrey Weinstein - Sendai Earthquake/Tsunami: Discussion of First-party Coverage Issues

Now that insurance adjusters are able to travel to Japan and observe the damage and devastation from the March 11 disaster, certain insurance coverage issues are becoming apparent. Jeffrey will discuss some of the more intriguing first-party insurance questions that are being presented to insurers for consideration, such as: 1) the contractual interactions among local fronting, captive, and "Difference in Conditions" policies; 2) the application of sublimits where policies provide limited coverage for earthquake, flood (sometimes including "tsunami"), and contingent time element loss; 3) the calculation of deductible(s); 4) the impact of "Territory" clauses; and 5) the need for and impact of reservation of rights letters.

James Veach - The GRID: the National Association of Insurance Receivers' (NAIC) Database Project

In 2004, the NAIC began to construct a Global Receivership Information Database to cover more than 1,200 insurer (and reinsurer) receiverships in the United States. The NAIC has completed Phase I of the GRID and is moving into Phase II. James will walk through the information available and how one accesses the GRID.

James will touch on a subtle shift away from the traditional U.S. receivership model and how efforts to mass-commute reinsurance liabilities, good bank/bad bank balance sheets, and even embrace schemes of arrangement will affect run-off within the U.S. receivership community. He will also touch on an NAIC White Paper on Restructuring Alternatives to Formal Receivership, a white paper that he helped draft.
